Section 4
Circumstances in which mutual legal assistance shall not be provided
Notwithstanding anything contained in Section 3, mutual legal assistance shall not be provided in the following cases:-
(a) in the case of a judicial proceeding in a matter of a civil nature in which the sum of less than one lakh rupees is subsisting,
(b) in the case of an offense punishable with imprisonment of less than one year or a fine of less than fifty thousand rupees in matters of a criminal nature,
(c) When providing mutual legal assistance in accordance with the request of a foreign state or if the public order (public order) or the sovereignty of Nepal is adverse due to the same.
